My aim in this comment is to provide reasons that highlight the importance of the Spanish translation of Brian Bix’s book: “Jurisprudence, Theory and Context”. My comment stems from the sociology of knowledge and takes as a point of departure an empirical study about the state of the art of legal philosophy in Mexican Law Schools. My conclusion is that Brian Bix’s work shows how Mexican legal philosophy might be incorporated into current jurisprudential debate.Resumen: El objetivo (...) de este comentario es proporcionar algunas razones a favor de la importancia de la publicación de la traducción al español del libro de Brian Bix “Jurisprudence, Theory and Context” para la actualización de la filosofía del derecho en México. Mi comentario es realizado desde la perspectiva de la sociología del conocimiento y tiene como punto de partida un estudio empírico sobre el estado del arte de la filosofía del derecho en las facultades de derecho del país. Mi conclusión es que el trabajo de Brian Bix responde la pregunta fundamental: ¿cómo incorporar a la filosofía del derecho mexicana al contexto global?, que estudiantes, profesores y jóvenes investigadores se plantean actualmente. Entre les postes et le mouvement analytique, le principe de plaisir et l'histoire des télécommunications, la carte postale et la lettre volée, bref le transfert de Socrate à Freud, et au-delà. Cette satire de la littérature épistolaire devait être farcie - d'adresses, de codes postaux, de missives cryptées, de lettres anonymes, le tout confié à tant de modes, de genres et de tons.

La présente contribution propose un panorama des représentations géographiques des lettres à Timothée et Tite, aussi appelées les Pastorales. À l’aide du concept de « carte mentale », elle montre comment les trois lettres remanient la perception spatiale du champ d’action paulinien d’est vers l’ouest, au tournant du ier et du IIe siècle. Le déplacement spatial identifié correspond à la majorité des études historiques qui situent les trois lettres parmi les premières réceptions de Paul. Il met également en évidence (...) les soubassements géographiques de la reconfiguration de la notion d’oikos dans ces premières réceptions, souvent occultés dans les études sur l’univers domestique des Pastorales. Nobody familiar with Norris’s distinguished career will be surprised to learn that his recent turn to versification (...) is not a repudiation of intellectual and rhetorical seriousness, but a re-emphasis of the same using resources not typically found in academic prose. Norris, an interdisciplinarian long before that term became a slogan, has in his work clocked up considerable epistemological mileage across diverse terrain, his critical friendship with deconstruction leading him to important interventions in analytic and Continental philosophy, institutional critique, philosophy of science and mathematics, legal studies, music, politics and, after all, creative criticism.Creative criticism is a relatively embryonic genre, until recently typified generally by a prose that owes a debt to Jacques Derrida’s Cir-confession, Glas and La carte postale. This is a style that foregrounds the philosophical unsaid – the repressed autobiographical, desirous, and otherwise messy constituents of that canon. It does so in part by jettisoning the academic politesse, and let’s say timidity, which help maintain such statutes of limitation. In a more specific way, creative criticism may be understood as a Romantic development set in train by the “Yale School” of deconstruction and its fellow travelers, straining in their own ways against the subordinate role of the reader and critic instituted by the likes of Matthew Arnold and T. S. Eliot.In the foreword to his 2017 volume The Winnowing Fan, Norris at once compliments this “strong” critical rebelliousness (xii), and critiques its ecstatic, quasi-apocalyptic hubris, provisionally aligning his own creative criticism with the “poetic diction” (xxi) of eighteenth-century figures such as Dryden and Pope. It is an analogy with caveats – not least Norris’s stated allergy to the “air of arrogance” (Tempus-Fugitives ix) of [End Page 122] their heavily end-stopped tendentiousness – but one which schematizes a poetics that both carries a definite argument and could not make this argument otherwise than in a manner reliant on verse’s formal properties.Note, however, the fact that Norris takes his distance from both strong criticism and those eighteenth-century essayists on the grounds of their shared self-assurance. A steadier presiding influence is William Empson, whose enmity towards Eliotic New Criticism, which “fixes a prescriptive gulf between poetry and other kinds of discourse,” makes him a political forebear, dissenting from modern forms of literary historical doctrinalism, specifically “that whole anti-rationalist complex of ideas that made the discontinuity between poetic and non-poetic language into a shibboleth of aesthetic, ethical, and (though rarely advertised as such) socio-political principle” (Tempus-Fugitives xix–xx). Norris is no straightforward disciple of Empson – who regarded Derrida, and the other “horrible Frenchmen” Norris used to invite him to read, as “so very disgusting, in a simple moral or social way, that I cannot stomach them” (qtd. in Haffenden 52). And yet, one constant quality of both Norris’s verse and prose criticism is a welcome sobriety of explication when it comes to the more recondite or outright flamboyant enclaves of modern European thought.A Partial Truth, and Norris’s books of verse generally, are explicit in outlining the ways in which his poetry functions as a reaction to the diaristic, mumbling slackness of much contemporary poetry; but does his turn to verse also indicate some reaction to contemporary theory? A Partial Truth’s “Foreword,” with modesty, states that “[i]f these poems have any distinctive merit then it lies in the treatment of interesting ideas in a way that deploys certain formal means to draw out complexities and further implications that would lie beyond the reach of a prose rendition” (14). In this essay I argue a particular legal philosophy is committed to a partial and closed view of how philosophical work is conceived. This view produces a legal philosophy that lacks the ability to guide substantive discussions. I argue that methodological legal positivism is not a good way to articulate the development of legal philosophy. Then, I argue that we need to consider the place that legal philosophy should occupy in the (...) global intellectual landscape. In addition, I develop my argument by distinguishing the work of legal-philosophy jurists from that of legal-philosophy philosophers and philosophy philosophers. As a coda, I sketch the criteria in order to conceive analytical legal philosophy from a new perspective.Resumen:En este ensayo defiendo que cierta forma de hacer filosofía jurídica está comprometida con una visión cerrada y parcial de concebir el quehacer filosófico. Esta visión genera una filosofía jurídica intelectualmente pobre y carente de capacidad para guiar debates sustantivos. In this essay I argue that in some sense legal philosophy, at least as the term is now understood among analytic jurisprudents in the Anglophone world, is to a large extent a creation of H. L. A. Hart’s work. It is with him that the search for the concept or the nature of law was one established as an independent object of inquiry, that consciously tried to avoid moral or political questions. In framing the province of jurisprudence in (...) this way Hart not only departed from the work of Thomas Hobbes and Jeremy Bentham, whose political commitments are clear, but also from the seemingly much closer enterprise of John Austin. After demonstrating this difference between Austin’s enterprise and Hart’s, I criticize the direction legal philosophy has taken following Hart’s lead.Resumen:En este ensayo se plantea la idea de que en cierto modo la filosofía del derecho —al menos en la forma en que es entendida entre los filósofos analíticos del mundo angloparlante— es en gran medida una invención de H. L. A. Hart. Con la obra de Hart, en efecto, la búsqueda del concepto o naturaleza del derecho, se ha consolidado como un objeto de investigación independiente, que conscientemente pretende deslindarse de las cuestiones políticas o morales. This article advances the claim that the Òrìṣà tradition is best conceived of as a legal tradition. Notwithstanding the fact that scholars have written extensively about the tradition from the perspectives of religion, philosophy, the arts, and many other domains of inquiry, I maintain that the extant scholarship has underrated the significance of tradition, and has almost completely overlooked the fact that the primary function of Òrìṣà is the improvement of social interaction through the governance and regulation of (...) conduct—which makes it a legal tradition. Nous vivons dans un monde problématique, sans certitudes fixes. Désormais l’expérience est celle d’un flux héraclitéen. Nous sommes devenus des marins. Les intégristes voudraient jeter l’ancre en pleine tempête et les relativistes se laisser aller au fil du courant. La seule issue est d’apprivoiser le devenir dans un processus de problématisation, dont la démarche scientifique fournit le paradigme, processus qui articule doutes et certitudes sans remettre tout en question à chaque fois et qui permet des résultats provisoires certes mais suffisamment (...) assurés pour progresser. Il faut donc concevoir l’éducation comme problématisation. Ce qui implique de doter les jeunes de nouveaux types de repères : boussole et cartes avec lesquels ils pourront s’orienter eux-mêmes sur le fond d’un héritage, d’une expérience transmise. Une philosophie de l’éducation inspirée de la problématologie de John Dewey et de Michel Meyer, permet un autre regard sur l’évolution des normes éducatives, sur les schèmes qui les sous-tendent, sur le savoir et la culture scolaire, sur l’émancipation. I won’t here sketch out completely the contentions of all phenomenologists about the question of Europe, what would rather refer to a book-project. By taking over some of the statements, I will rather try to situate Max Scheler’s original contention, while showing, to begin with, how he concurs with some aspects of Husserl’s pionneer-conception, but also strongly disagree on some others. As a second step, the map of the contentions of the different phenomenologists on Europe will allow to draw a (...) fairly enough dividing line between euro-centrists or europeo-centrists on the one side and, on the other side, the promotors of an alternative Europe, of an « alter-Europe », of a euro-excentrism, or again, in more contemporary terms, of a « globalisation » or an « alter-mondialism ». Max Scheler is clearly on this latter side of the line, as we will see. But this dividing line becomes still more complex and generates other distinctions, according to the « valence » that is attributed to Europe, positive (its opening future) or negative (its foreseen decline), or, in other terms, if it is its metaphysical meaning (principle, idea, essence, value) that is underlined, or its social, legal, economic and political historicisation. With such a multifactorial configuration in mind, I will seek to place the author of Politisch-pädagogische Schriften and, namely, of « L’idée de paix et le pacifisme » on the chessboard of Europe. There are few problems to which legal philosophers have devoted more attention than the relationship between morality and law, or, said in different terms, between the “good” and the “obligatory”. One might think that all that should and could be said about it has already been uttered or written. Nevertheless philosophy — and legal philosophy is no exception — is just this: rethinking old problems which are in fact always new,1 and for which no definitive solution (...) is given — nor is possible, I would add — and which need a permanent effort of reassessment. DavidHume, a member of the well-known Border family of Home, was born on April 26, 1711. After a period of preparatory training he matriculated at Edinburgh College in 1723, although he may have entered earlier. His course during this period is obscure; according to his own statement the curriculum was mainly literary; on leaving College he records that his interests lay predominantly in this direction, and, being left to his own choice, he was able to indulge his inclinations. WATSON WITHIN CARTESIANISMthere arose many problems deriving from conflicts between Cartesian principles. Inadequate attempts to solve these problems were crucial reasons for the breakdown of Cartesian metaphysics in the late seventeenth and early eighteenth centuries. The major difficulties derived from the acceptance of a dualism of substances seated in a system which included epistemological and (...) causal likeness principles plus an ontological framework in which the categories of substance and modification were exhaustive. The major solutions involved either denying the likeness principles or altering the ontological framework. The first led to unintelligibility ; the second, culminating in Hume, opened the way to non-Cartesian metaphysics. The first section of this study contains a characterization of late seventeenth -century Cartesian metaphysics. The second is an exposition of Foucher 's four major criticisms of this system. In the third section, monistic solutions suggested in Descartes and by Spinoza, Foucher, Leibniz, and Locke are considered; in the fourth, the dualistic solutions of the orthodox Cartesians Rohault, R~gis, Desgabets, La Forge, Le Grand, and Arnauld; and in the fifth, the occasionalist solution of Malebranche. The sixth section is an analysis of these orthodox and occasionalist solutions, showing how each ultimately fails because of dependence upon the ontology of substance and modification. The seventh section is a consideration of Berkeley and Hume in the Cartesian context. A consideration of their systems as offering solutions to Cartesian problems illuminates in new light both the systems and the problems. In broad terms, this study moves from a consideration of problems arising from an ontology of two substances, to a consideration of problems arising from the ontological pattern of substance and modification. The Cartesians were concerned with relationships between two substances, but they saw no difficulties connected with the relationship between a substance and its modifications (or properties). Berkeley's treatment (deriving from Male- [177] 178 HISTORY OF PHILOSOPHY branche) of the relationships between mind and idea, and between mind and notion, is illuminated by a consideration of the extent to which he took these relationships for granted in the Cartesian way, and of the extent to which he saw difficulties in the relationship between substance and modification. The Berkeleian solution to Cartesian problems, like that of Malebranche before him, was not successful; Malebranche belittled, and Berkeley denied the dualism of substances, but neither philosopher could break entirely with the ontological pattern of substance and modification. The final breakdown of Cartesian metaphysics came with Hume, who, in providing the culmination of a most important trend in modern philosophy, opened the way to new metaphysics and became the father of contemporary philosophy. I A model late seventeenth-century Cartesian metaphysical system. The last grand expositor of the Cartesian philosophy was Antoine Le Grand who in 1694 published An Entire Body of Philosophy. The characterization of the late seventeenth-century Cartesian system given below follows Le Grand's exposition more closely than others, but it also incorporates elements from those of Rohault, R6gis, Desgabets, La Forge, Malebranche, and Arnauld.1 None of these philosophers professed a system of exactly the sort this characterization pictures, nor is it implied here that they do. Automne 1876: Nietzsche, jeune professeur de philologie à Bâle, brillant élève de Ritschl, part pour Sorrente, invité par son amie Malwida von Meysenbug. C'est son premier voyage dans le Sud : une découverte qui va changer sa vie et le cours de sa philosophie. C'en est fini des tentatives de renouveler la culture allemande au nom de la cause wagnérienne ; l'auteur de La Naissance de la tragédie (1872) commence sa mue. Paolo D'Iorio dresse la carte de cette métamorphose (...) : lectures et discussions, promenades, explorations des environs avec son ami Paul Rée et l'étudiant Albert Brenner ; il fait revivre cette sociabilité joyeuse et confiante qui fertilise l'élan créateur de Nietzsche. C'est à Sorrente que Nietzsche entreprend la rédaction de Choses humaines, trop humaines, dédié à Voltaire. Cette oeuvre, la première sous forme d'aphorismes, inaugure sa philosophie de la maturité. La rupture avec Wagner qu'il verra alors pour la dernière fois, est intellectuellement consommée bien qu'encore cachée. A permanent approach to what law is has been that of interpreting it in terms of repression or reduction of chances or courses of conduct. This approach, however, is not able to render justice to fundamental moments of the legal practice, beginning with constitutional law and its empowering rules. Nonetheless, the mainstream in the philosophy of law and in the legal theory has not at all been worried about this strange inadequacy of imperativism to offer a complete (...) view of legal practice and legal institutions. Force, violence, sanction, prescription still are the basic conceptual knots used to weave the cloth of law and lawyers. Hannah Arendt perceptive though scanty remarks on law, within her wider reflections on action and judgment, offer a different view and open a new path for a jurisprudence less obsessed with coercion, and against the tradition supporting the centrality of command in the tlegal domain. Such view and that path this paper tries sympathetically to explore. (shrink)

English summary: Often considered as an orientation and navigation tool, maps are intended to reassure us as we navigate on the earth. But what would happen if we were travelling with maps which disorient us? There certainly is no shortage of maps, but they are not all equally reliable! Some merely reproduce reality, while others, to the contrary, invent it. In addition to external maps used by geographers-geodesists-land surveyors, there are internal maps used by cosmographers-painters-writers and, indeed, all those whose (...) lines fire the imagination, as did Michaux, who said, I want my lines to be the very phrasing of life. The maps which will concern us here are precisely those which resist the tyranny of analogy to plunge us into the mad depths of these uncertain outlines. Such memory-bereft maps leave tracks and yet refuse to follow any sort of path. In doing so, they drag us off into improbable and unknown geographies. This journey is taken by means of a dialogue woven between Michaux's poetic works and Merleau-Ponty's philosophical writings. It also provides an opportunity to clarify Maurice Blanchot's theory expressing the main theme of the following words: Thus were they walking, immobile within the movement. These unfamiliar maps afford us an occasion to advance immobile within the movement, as if to tell us that the fixation points drawn by spatial geometry consist first and foremost of the fictional points invented by geometry. French description: SOUVENT ENVISAGEE comme un instrument d'orientation et de navigation, la carte sert a nous rassurer dans notre lecture du territoire. Mais qu'adviendrait-il si l'on voyageait avec des cartes qui nous desorientaient? Les cartes sont nombreuses certes, mais elles n'ont pas toutes les memes vertus! ABSTRACT Scholars have understood Aristotle’s theory of equity in two different ways. On the one hand, some claim that equity is an extra-normative criterion, that is, it goes beyond the law and reaches a supra-legal level identified with a metaphysical order of natural justice. On the other hand, some hold that equity is intra-normative, that is, the judge rectifes legal justice without going beyond its limits. Considering this second point of view and by using a methodology that combines (...) legal philosophy and some of the main theories about emotions in ancient Greece, this paper aims to demonstrate that equitable judges should not have broad discretion according to Aristotle’s thought. To hold that claim, I will mainly address the role of emotions in the formation of judgment and the power they have to endanger the possibility of giving just and rational judicial decisions. Philosophy and conception of Divine authority in legal terms.

Italian philosopher Giorgio Agamben is the rare writer whose ideas and works have a broad appeal across many fields, and his devoted fans are not just philosophers, but readers of political and legal theory, sociology, and literary criticism as well. In March 2009, Agamben was invited to speak in Paris’ Notre-Dame Cathedral in the presence of the Bishop of Paris and a number of other high-ranking church officials. Frank and William DriscollScholars do not have access to a complete bibliography of the new rhetoric project. We have redressed this problem by compiling what we believe is the most comprehensive bibliography to date of the works of Chaïm Perelman and of those he coauthored with Lucie Olbrechts-Tyteca. The bibliography includes all the English and French titles, as well as titles (...) that saw first publication in other languages. Translations we believe Perelman may have authorized or endorsed are included.With this bibliography, scholars can now better understand how the new rhetoric project was conceived and how it unfolded. Within the larger constellation of the project, Perelman's bibliography is the most extensive, numbering almost three hundred entries. The trajectory of Perelman's scholarship reveals the origins of the new rhetoric project and how it evolved between the time of his announcement in 1949 that he and Olbrechts-Tyteca had embarked on a program designed to rehabilitate reason and the period of his final articles in the 1980s. A review of the articles and books that came out of the Perelman and Olbrechts-Tyteca collaboration reveals both a phase of conceptualization and development of the project and a phase of culmination. In the first phase, commencing with Rhétorique et philosophie, the authors established the need for a rhetorically grounded philosophy. As they built toward the publication of the Traité, [End Page 449] the culmination of their ten-year effort, they wrote articles elaborating on "notions" in argumentation (1955) and on the tenets of the "new rhetoric" (1956). In 1958, the year the Traité appeared, they published articles on classical and romantic loci in argumentation and on time in argumentation. With the exception of a 1983 tribute to the theorist Pareto, they did not write together after 1958 but instead pursued separate lines of research out of their collaboration. Does a proper understanding of the role of philosophical inquiry and its re- lation to scientific inquiry entail that we should replace conceptual analysis with another methodology? Brian Leiter supports that conclusion by offer- ing a methodological criticism of recent analytical legal philosophy. Les pensées contemporaines de l’événement, tout comme la langue de tous, déterminent l’événement comme étant une exception sur l’ordre normal du monde. À la différence des faits, les événements ont un caractère exceptionnel qui provient pour l’essentiel de leur caractère assigné, adressé. Alors que les faits intramondains sont ouverts à tous, l’événement est toujours vécu à la première personne, de façon unique et non-itérable. Grâce à une lecture comparée des théories de l’événement de Claude Romano, Alain Badiou et Jean-Luc Marion, (...) nous questionnons ce problème de l’adresse et posons une adestination essentielle de l’événement, nous obligeant par là à penser non pas une exceptionnalité de l’événement mais au contraire sa grande banalité. Etude de la pensée cartésienne sur la chute des corps basée sur l'analyse d'extraits de textes et de lettres. Elle met en avant la concomitance des travaux de Descartes avec ceux de Galilée et la similitude des problèmes abordés par les deux savants : élaboration des concepts de base de la cinématique et problèmes de composition du continu et de passage à la limite.

Quelle place donner a l'histoire de la philosophie? Tradition analytique et tradition francaise ont eu longtemps des reponses tellement opposees, qu'une tradition pouvait rejeter l'autre d'apres ce seul critere; ceux qui condamnaient la reduction de la philosophie a l'histoire des idees et denoncaient l'oubli de la dimension intemporelle des argumentations valides, etaient eux memes critiques pour la naivete de leur silence sur la dimension historique de toute reflexion philosophique. Les positions ont evolue de chaque cote: un nouveau tournant philosophique, l'existence (...) d'un courant post-analytique, la qualite du travail historique, la percee de la philosophie analytique sur le continent,... ont change les rapports. Die Fortschritte in der Psychopharmakologie führen zu einem immer breiteren Angebot an Substanzen zur Verbesserung der Stimmung, des Gedächtnisses oder der exekutiven Funktionen. Dieses Angebot trifft auf die Wünsche und Bedürfnisse vieler Menschen, ihre mentalen Leistungen und Zustände zu verbessern. Wie sollte die Medizin mit diesen Wünschen umgehen? An welchen Kriterien sollte sich insbesondere der ärztliche Entscheidungsprozess orientieren? Im Folgenden soll gezeigt werden, dass sich aus einer „Treatment-enhancement-Unterscheidung“, einem Krankheits- oder Normalitätsbegriff oder einem bestimmten Medizinkonzept keine zielführenden normativen Kriterien für (...) diesen Entscheidungsprozess ableiten lassen. Demgegenüber wird ein Entscheidungsmodell entwickelt, das auf traditionellen Kriterien ärztlichen Handelns beruht: dem Kriterium des Wohlergehens, des Nichtschadens und der Autonomie. Mit diesem Modell soll zugleich ein neues Konzept einer „wunscherfüllenden Medizin“ vorgeschlagen werden: eine subjektive Medizin mit ärztlichem Empfehlungs- und Vetovorbehalt. (shrink)

David Hume , a member of the well-known Border family of Home, was born on April 26, 1711. After a period of preparatory training he matriculated at Edinburgh College in 1723, although he may have entered earlier. His course during this period is obscure; according to his own statement the curriculum was mainly literary; on leaving College he records that his interests lay predominantly in this direction, and, being left to his own choice, he was able to indulge his inclinations. Cicero's main philosophical interest is in practical philosophy. This interest stemmed from his legal career and from his political activity. As a result of his philosophy, Greek moral philosophy was received in Latin culture. Cicero is, in his life and his works, the refusal of the moral, anthropological and political nihilism. His ideas, very present in the moral and political philosophy of the Middle Ages, continue being a key for contemporary world views.

Descartes est la figure emblématique de la naissance des temps modernes. Le « je pense, je suis » par lequel il aurait traduit l'autonomie de la raison marquerait l'affranchissement à l'égard de toute autorité transcendante. En réalité, c'est pourtant Dieu que Descartes invoque comme garantie de la vérité de sa découverte. Dieu occupe d'ailleurs la place centrale dans les systèmes philosophiques du « Grand Siècle ». La vraie révolution de la modernité, celle de la science, celle de l'observation de la (...) nature, celle de l'induction, les grands philosophes du XVIe siècle, tels Malebranche, Spinoza, Leibniz et Descartes ne l'auront pas connue. La place qu'ils occupent comme fondateurs de la modernité est une place usurpée, reconduite par une tradition philosophique qui persiste à se réfugier derrière des abstractions plutôt que de s'inspirer de la démarche scientifique. L'invocation du patronage cartésien comme modèle de rigueur intellectuelle et comme fondateur du rationalisme moderne, cette « révolution cartésienne », origine mythique de la modernité en philosophie, n'a jamais eu lieu. Le XVIIe siècle est le siècle de l'induction et de la science expérimentale. Le siècle de Bacon, de Galilée et de Newton... Une erreur ou une distorsion de la réalité répétée mille fois devient vérité. Nous vivons sous un régime d'écriture cartésien. Cet ouvrage place l'histoire future de la philosophie sous l'emprise de la résistance au cartésianisme. (shrink)

C’est le sens du discours cartésien qui, à travers une lecture subtile de l’œuvre et de ses commentateurs, est ici interrogé dans sa globalité. Interrogation fouillée qui met en lumière l’inspiration néo-platonicienne (...) de Descartes et les relations ambivalentes qui l’unissent aux penseurs de la Renaissance, loin des réductions heidegériennes. In this article I compare the phenomenology of Husserl with Polo’s philosophy of the mental limit. This comparison is orientated to highlight the importance of habits in anthropology.

Deborah Mayo's view of science is that learning occurs by severely testing specific hypotheses. Mayo expounded this thesis in her (1996) Error and the Growth of Experimental Knowledge (EGEK). This volume consists of a series of exchanges between Mayo and distinguished philosophers representing competing views of the philosophy of science. The tone of the exchanges is lively, edifying and enjoyable. Mayo's error-statistical philosophy of science is critiqued in the light of positions which place more emphasis on large-scale theories. The result clarifies Mayo's account and highlights her contribution to the philosophy of science -- in particular, her contribution to the philosophy of those sciences that rely heavily on statistical analysis. The second half of the volume considers the application (or extension) of an error-statistical philosophy of science to theory testing in economics, causal modelling and legal epistemology. La presente investigación tuvo como objetivo realizar un análisis del procedimiento abreviado contemplado en el Código Orgánico Integral Penal (COIP), partiendo del criterio de que ciertos aspectos de este procedimiento vulneran derechos fundamentales del investigado. Se destaca particularmente el requisito para el procesado de admitir los hechos que se le imputan para acceder a este procedimiento, lo cual, según la opinión mayoritaria de doctrinarios, compromete el principio de no autoincriminación, la presunción de inocencia y el derecho a un juicio con (...) todas sus fases. El objetivo de esta investigación fue analizar el procedimiento abreviado establecido en el Código Orgánico Integral Penal (COIP), con el propósito de identificar posibles vulneraciones de derechos fundamentales del investigado. Se buscó específicamente evaluar cómo el requisito de admitir los hechos imputados para acceder a este procedimiento podría afectar principios como el de no autoincriminación y la presunción de inocencia. A través de un enfoque cualitativo y utilizando diferentes métodos de análisis, se procuró determinar si el procedimiento abreviado, tal como está configurado, garantiza un debido proceso conforme a los estándares de derechos humanos y constitucionales. La metodología aplicada se sustentó en un enfoque cualitativo, utilizando los métodos inductivo, analítico, sintético y exegético. Se llevó a cabo un análisis documental de la bibliografía relacionada con el tema investigado, así como de instrumentos internacionales de Derechos Humanos, la Constitución de la República de Ecuador, el COIP y jurisprudencia vinculada a la materia. Los resultados de la investigación determinaron que el procedimiento abreviado tal como se encuentra regulado en el COIP beneficia al Estado y al sistema de justicia al agilizar ciertos procesos legales. Sin embargo, se evidenció que este procedimiento puede vulnerar derechos esenciales del procesado, como el principio de no autoincriminación y la presunción de inocencia. Por lo tanto, se concluye que el procedimiento abreviado afecta el debido proceso al comprometer garantías fundamentales. La investigación señala que el procedimiento abreviado regulado en el COIP, si bien puede ser beneficioso para la eficiencia del sistema de justicia, también conlleva riesgos significativos de vulnerar derechos fundamentales del procesado. Por lo tanto, se destaca la necesidad de revisar y modificar este procedimiento para garantizar el respeto absoluto al debido proceso y a las garantías individuales del investigado. (shrink)

Resumen En este artículo defiendo la postura según la cual el republicanismo -en comparación con otras nociones o motivos centrales- no se ha interpretado como uno de los rasgos que caracteriza a la filosofía jurídica y política de Kant como un todo. Una posible razón es que el republicanismo kantiano no ha ocupado un lugar destacado dentro de las narrativas republicanas, ya sea históricas o sistemáticas, que son más dominantes en las discusiones contemporáneas. A mi parecer, esto es así porque (...) hay características innovadoras en la empresa republicana kantiana que se encuentran en tensión con otros proyectos republicanos de otra índole. Aquí discuto algunos de los rasgos distintivos del proyecto de Kant en lo que atañe a concepciones suyas sobre el estado de derecho, la ciudadanía, la autoridad política, la libertad de expresión y el derecho internacional, con el fin de señalar que estas son parte integral de una teoría política y legal que todavía es atractiva y sugerente.In this paper, I defend the stance that republicanism -in comparison to other central notions- has not been interpreted as one of the main traits that characterize Kant’s legal and political philosophy. A plausible reason for this is that Kantian republicanism has not occupied a prominent place in the republican narratives, historiographical or systematic, that are dominant in contemporary discussions. To my mind, the reason for this is that some innovative characteristics in the Kantian republican enterprise are at odds with other republican philosophical projects. Here I discuss some distinctive traits of Kant’s project regarding his conceptions of the rule of law, citizenship, political authority, free speech, and international law with the aim of showing that they are an integral part of a political and legal theory that is still attractive and compelling. Ce que «repenser» veut dire, nous ne le comprenons que si nous nous demandons au préalable ce que «penser» veut dire. Pour Heidegger, cela revient à se demander ce qui nous appelle à penser, pour Kant, c’est se demander comment on peut s’orienter dans la pensée, pour Nietzsche, ce qui nous pousse à penser, à quoi j’ajouterai la question, moins (...) connue et plus déconcertante, d’Eugen Rosenstock-Huessy dans son essai sur la «pensée dative»: «Cui cogitatur?», «À qui nos pensées sont-elles destinées?»À quoi nos pensées sont-elles dédiées?, à qui sont-elles destinées?: c’est la tension féconde entre ces deux questions qui nous met sur la voie d’une réflexion sur le sens que le verbe «repenser» peut revêtir dans la bouche d’un philosophe. À la différence de ceux qui s’imaginent que «repenser» veut dire simplement distribuer un peu différemment les cartes du savoir, les vrais «repenseurs» ne cessent de se demander à quel jeu ils jouent quand il s’efforcent de penser philosophiquement et ils cherchent à avoir une conscience plus nette des enjeux de ces jeux de la pensée. For many children with complex medical conditions, decisions regarding their goals of care lie in the zone of parental discretion. That is, clinicians appropriately recognize that in many cases whether to prioritize quantity of life or quality of life is a deeply personal, values-laden decision best made by those who are most deeply invested in the outcome. Once a family has committed to a goal, however, there may be new or ongoing conflict between parents and clinicians regarding the specific interventions (...) provided or not provided in support of that goal. To what extent is it ethically permissible for a seriously ill child’s surrogate decision makers to reject individual interventions that support their desired goal of care? This question might be best described thus: is pediatric healthcare “prix fixe,” in which clinicians help parents decide the best of one or more set combinations (“menus”) of interventions, or is it “à la carte,” in which parents are free to accept or reject each individual intervention? We argue that the concept of a “prix fixe” approach should be discussed with families early in the development of the clinical relationship, as an essential facet of shared decision making. (shrink)
